These terms and conditions govern sales by La Biche qui Coud, a sole proprietorship, registered in the Marseille Trade and Companies Register under number 919 365 239.

La Biche Qui Coud is a company that creates and publishes historical sewing patterns for children and adults for consumers, marketed through its website www.labichequicoud.com.

ARTICLE 1 - PRODUCTS

The company La Biche qui Coud presents on its website www.labichequicou.com the products for sale with the necessary characteristics to enable compliance with Article L 111-1 of the Consumer Code, which provides for the possibility for the potential consumer to know the essential characteristics of the products that he/she wishes to purchase before placing a final order.

The products offered comply with European marketing standards. The photographs, texts, graphics, information and characteristics reproduced and illustrating the products presented are not contractual. Consequently, La Biche Qui Coud may not be held liable in the event of an error or omission in one of these photographs, texts or graphics, information or product characteristics.

La Biche Qui Coud cannot be held responsible for the non-execution of the contract due to any case of force majeure.

ARTICLE 2 - PRICES

The prices of our products are indicated in euros, inclusive of all taxes (VAT and other taxes applicable on the date of the order).
La Biche Qui Coud reserves the right to modify its prices at any time, but the product will be invoiced on the basis of the price list in force at the time the order is validated and subject to availability.
The products remain the property of La Biche Qui Coud until full payment has been received.

ARTICLE 3 - ORDERS

The contractual information is presented in French and will be confirmed at the latest at the time of validation of your order.
La Biche Qui Coud reserves the right not to record a payment and not to confirm an order for any reason whatsoever, especially in case of supply problems or difficulties concerning the received order.

ARTICLE 4 - VALIDATION OF YOUR ORDER

Any order appearing on the website www.labichequicoud.com implies adherence to these General Conditions. Any confirmation of the order entails your full and entire adherence to these general conditions of sale, without exception or reservation.
The data provided and the recorded confirmation will be proof of the transaction.
You declare to have perfect knowledge of it.
The order confirmation will be considered as a signature and acceptance of the operations carried out.
A summary of your order information and these General Terms and Conditions will be sent to you via the e-mail address used to confirm your order.
Any consumer order signed by "double click" constitutes an irrevocable acceptance which can only be challenged in the cases limitedly provided for in these general conditions of sale including the tariff conditions like "right of withdrawal" and "stock shortage".

ARTICLE 5 - PAYMENT

Validating your order implies for you the obligation to pay the indicated price.
Payment for your purchases is made by credit card via the Paybox payment gateway.
The card is debited at the time of the order.
La Biche Qui Coud reserves the right to suspend any order management and any delivery in case of refusal of payment authorization by officially accredited organizations or in case of non-payment.
La Biche Qui Coud reserves the right not to honour an order from a consumer who has not paid in full or in part for a previous order or with whom a payment dispute is in progress.

ARTICLE 6 – WITHDRAWAL

EXCEPTIONS TO THE RIGHT OF WITHDRAWAL
In accordance with Article L 121-20-2 of the Consumer Code, this right of withdrawal cannot be exercised for intangible products, i.e., patterns purchased in PDF format and E-gift cards, as well as for fabrics cut to order.

ARTICLE 7- AVAILABILITY

Our products are offered as long as they are visible on the site www.labichequicoud.com and within the limits of available stocks.
If a product is unavailable after you have placed your order, we will inform you by e-mail. The customer will then have the option of cancelling the order within 48 hours and may request either a refund or an exchange for a product of equivalent characteristics and price, if La Biche Qui Coud is able to obtain it.
En cas d’impossibilité d’échange, La Biche Qui Coud se réserve le droit d’annuler la commande du client et de rembourser les sommes versées.

ARTICLE 8 - DELIVERY

Products are delivered to the e-mail address indicated during the order process, within the time indicated on the order validation page.
In case of shipping delay, an email will be sent to you to inform you of a possible consequence on the delivery time that was indicated to you.
In accordance with legal provisions, in the event of late delivery, you may cancel the order in accordance with the terms and conditions set out in article L 138-2 of the French Consumer Code.
The customer must check the completeness and conformity of the information provided to La Biche Qui Coud. La Biche Qui Coud cannot be held responsible for any data entry errors that may lead to delays or errors in delivery. In this context, all costs incurred for the reshipment of the order will be entirely at the customer's expense.
La Biche Qui Coud cannot be held responsible for delays in delivery due to errors or disruptions attributable to carriers/Internet connections.

ARTICLE 9 - APPLICABLE LAW IN CASE OF DISPUTES

The language of this contract is French. These conditions of sale are subject to French law. In case of dispute, the French courts will have sole jurisdiction.

ARTICLE 10 - INTELLECTUAL PROPERTY

All elements of the www.labichequicoud.com website are and remain the exclusive intellectual property of La Biche Qui Coud. No one is authorised to reproduce, exploit, rebroadcast or use for any purpose whatsoever, even partially, any elements of the site, whether software, visual or audio. Any simple link or hypertext link is strictly prohibited without the express written consent of La Biche Qui Coud.
By purchasing a La Biche Qui Coud pattern, the Customer acknowledges that its use will be exclusively individual, personal, and private. We request support for small creators by asking the customer not to transfer to a third party the product purchased, whether it is in digital PDF format or paper.
The Customer, prior to their order, declares that the use of the purchased products is unrelated to their professional activity, their acquisition being reserved for strictly personal use on their part.
The Customer undertakes to respect the regulations on intellectual property as well as, more specifically, the following conditions of use (non-exhaustive list):

  • use the purchased products exclusively for individual and private use; not to copy, sell, give away, transfer, exchange, in any form (electronic version or after printing on paper support, in particular), under any title whatsoever, by any means whatsoever, all or part of the products, even in a non-commercial setting;
  • print the patterns only in the formats offered in the context of patterns marketed in PDF format; not to reproduce and reuse the contents of the products to propose or redistribute them on any medium outside the strict legal framework of private copying,
  • Do not commercialize clothing and accessories made from La Biche Qui Coud patterns.
  • Do not use La Biche Qui Coud patterns as materials for sewing courses, except with prior authorization.

ARTICLE 11 - PERSONAL DATA

La Biche Qui Coud reserves the right to collect nominative information and personal data about you. This information is required to process your order and to improve the services and information we send you.
They may also be transmitted to companies that contribute to these relations, such as those responsible for the execution of services and orders for their management, execution, processing, and payment.
These information and data are also kept for security purposes, in order to comply with legal and regulatory obligations.
In accordance with the law of January 6, 1978, you have the right to access, rectify, and oppose nominative information and personal data concerning you, directly on the website.

ARTICLE 12 - ARCHIVING PROOF

The company La Biche Qui Coud will archive order forms and invoices on a reliable and durable medium constituting a true copy in accordance with the provisions of article 1348 of the French Civil Code.
La Biche Qui Coud's computerised records will be considered by all parties concerned as proof of communications, orders, payments and transactions between the parties.
